Understanding Types of Distribution

Types of Distributions:

When creating a living trust or will, it's important to understand the different ways you can distribute your assets to your beneficiaries. Three common methods are Per Stirpes, Per Capita, and Specific Bequests.
Let's explore each of these options:

1) Per Stirpes

“By Branch” Distribution

Per Stirpes means that if a beneficiary (like your child) dies before you, their share goes to their children (your grandchildren), divided equally.
This way, each branch of your family still receives their portion, even if someone in that branch has passed away.

Example:

You have three children. You plan to divide your assets equally among them.
If one of your children passes away before you but has two kids of their own, their 1/3 share would be split between their two children.
The other two children still receive 1/3 each.

2) Per Capita

“By Head” Distribution

Per Capita means your assets are split equally among all living beneficiaries of the same generation.
If one beneficiary dies before you, their share is re-divided among the survivors—it does not pass to their children.

Example:

You have three children. If one dies before you, the remaining two children receive half each.
The children (your grandchildren) of the deceased child receive nothing under this method.

3) Specific Bequests

Leave Specific Items or Amounts to Specific People

This allows you to assign particular assets to certain individuals.
It’s useful when you want to leave specific property, cash, or sentimental items to someone.

Example:

Your daughter receives your wedding ring.
Your son receives $50,000.
Your grandchild receives your vacation home.

What You Should Know

A guardian ad litem is someone a court may appoint to represent the best interests of a minor or incapacitated beneficiary during a legal proceeding involving your trust.

They do not take custody or manage money — their job is to speak for and protect the beneficiary’s legal interests if something ever needs to go through the court.
This usually only comes into play if there’s a dispute, complex distribution, or court review involving a beneficiary who can't legally speak for themselves.

Why Am I Naming One in This Trust?

You are recommending someone the court should consider appointing if the need arises.
Courts usually give weight to your nomination, but they are not obligated to follow it — a guardian ad litem must still be formally appointed by a judge.

Pour-Over Will

The backup document that ensures any assets not placed in your trust are transferred into it after your death.

What You Should Know

A pour-over will is a backup legal document that works alongside your trust.
It’s designed to "catch" any assets you didn’t formally transfer into your trust during your lifetime and “pour” them into the trust when you pass away.
It ensures that anything accidentally left out of your trust — like a forgotten bank account or a new car, is still directed according to your trust instructions.
The pour-over will go through probate, but it protects your long-term intent by making sure everything ends up in the trust.

Why Is This Important?

Even with the best planning, people often forget to transfer some assets into their trust.
Without a pour-over will, any assets left outside the trust may be distributed according to state law, not your wishes.
This document helps make sure that everything you own ends up where it belongs, even if something was missed.

Who Should You Choose as Executor?

The executor of your pour-over will is the person who:
- Works with the court to gather and transfer assets into your trust
- Helps ensure any debts or taxes are settled
- Coordinates with your trustee, since the trust ultimately receives those assets

What You Should Know

California is a community property (CP) state, which means that most assets acquired or earned during your marriage are presumed to be jointly owned by both spouses.

However, assets that were:
- Owned before marriage,
- Received by gift or inheritance, or
- Kept separate and titled individually,
Can be considered separate property (SP) if clearly identified and maintained that way

When listing your assets:
- Indicate if the asset is SP or CP
- Use S1 for Spouse One or S2 for Spouse Two when marking separate property
- Include the approximate value of each asset

Why It Matters

Understanding which assets are community vs. separate can affect how they are distributed and how your estate is structured.
The total fair market value of your estate helps determine if you may need additional planning tools (like tax strategies or advanced protections).
Accurately listing and valuing your assets ensures your trust reflects your wishes and complies with California law.

What Is “Funding” the Trust?

Funding is the process of placing assets into your trust so they are legally owned by it.
- Many of your core assets (real estate, business interests, personal property) will be transferred during the setup process.
- Financial accounts, however, must be funded by you directly with your financial institutions.
You will receive a Certification of Trust, which:
- Confirms the existence of your trust
- Allows banks, brokerages, and other entities to retitle accounts into your trust
- Should be kept handy for future asset changes or account openings

What You Need to Do

Accurately list your assets with ownership type (CP or SP) and estimated value
Use the Certification of Trust to update financial accounts
Review your completed estate planning portfolio for additional instructions

Properly funding your trust is one of the most important steps in making sure your estate plan works — and your assets are protected and distributed as intended.
